1. Agreement to these Terms
These Terms of Service ("Terms") govern your use of the NAVU mobile application, website, and related services (the "Service"). By accessing or using the Service, you agree to these Terms. The NAVU Privacy Notice explains information practices. Accepting these Terms does not itself grant permission for third-party AI transmission or sensitive-data processing. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and legally capable of entering into these Terms to use NAVU. The Service is not offered to persons under 18. The current beta is intended for adults in the United States; wider availability is a future plan subject to additional review.
3. What NAVU is
NAVU is for everyday planning and general wellness. It can help organize meals and practical steps around preferences, allergies, or a limit you supply, including an instruction from your healthcare professional. It must not derive a treatment target from a diagnosis, interpret medical records to decide care, diagnose, prescribe, or change medication. Nutrition figures are estimates. NAVU is not a medical device and does not diagnose, treat, cure, or prevent a medical condition. Consult a healthcare professional for medical advice, diagnosis, or treatment.
NAVU is an AI-assisted consumer product designed to provide practical everyday help. Meals are an initial use case. NAVU may also support other general planning or organizational tasks as features are introduced. NAVU is not a therapy service, medical service, legal service, financial advisory service, or emergency service.
4. Core access and optional paid activity
NAVU's core practical consumer help stays free and does not require a subscription. Optional marketplace purchases, third-party goods or services, partner offers, or other optional transactions may involve charges. Any price or fee will be disclosed before you choose to complete the transaction.
5. AI-generated content and limitations
NAVU uses artificial intelligence. AI-generated content can be incomplete, outdated, inaccurate, repetitive, or inappropriate for your specific circumstances. You are responsible for reviewing outputs before relying on them and for using ordinary judgment, including food-safety judgment.
- Nutrition, calories, macros, serving sizes, and similar values are general planning estimates unless expressly stated otherwise.
- Dietary or allergy settings help NAVU filter suggestions but do not guarantee that any meal, ingredient, brand, or preparation is safe for a particular allergy, intolerance, or medical condition.
- NAVU does not diagnose, treat, prevent, or manage disease and does not provide clinical nutrition or medical advice.
- NAVU does not provide legal or financial advice or make high-impact eligibility, employment, housing, credit, insurance, healthcare, or similar decisions for you.
- If you have an emergency or urgent professional need, use the appropriate emergency service or qualified professional rather than relying on NAVU.
6. Your content and instructions
NAVU has a curated recipe catalog shipped with the service. Curated means selected and structured for the product; it does not mean medically verified. Using that catalog, generating a response, keeping a private recipe, learning from user feedback, and training an AI model are different activities. The deployed backend disables shared user-feedback learning and reuse of generated recipes in the shared catalog. User-supplied context can still guide the answer you request. This is not training the underlying model.
You retain whatever rights you have in content you submit to NAVU ("User Content"). You give NAVU a limited, nonexclusive license to host, process, transmit, reproduce, and transform User Content only as reasonably necessary to provide, secure, maintain, troubleshoot, and improve the non-training operation and reliability of the Service as described in the Privacy Notice. This license does not authorize model training, fine-tuning, distillation, teacher/student optimization, training exports, or permanent shared DataWheel promotion of your content. It does not replace any legally required consent.
During DataWheel shadow mode, NAVU does not permanently promote real user-derived content into the shared DataWheel knowledge library. Private conversation history and private profile information are not the shared DataWheel product. Candidates entering its evaluation stage are checked in memory and discarded without retention in shared storage, shared caches, DataWheel logs, or DataWheel error reports; not every generated response goes through that stage. If NAVU later enables permanent retention or shared-library promotion, the applicable disclosures will be updated and any legally required consent obtained before activation.
7. Private saved items
If NAVU allows you to save meals, lists, preferences, or other items, those private saved items remain separate from the shared DataWheel unless a future feature expressly tells you otherwise and the applicable privacy disclosures permit it. You are responsible for maintaining any device or account access needed to retrieve private saved items.
8. Acceptable use
You may not use NAVU to:
- violate law or the rights of others;
- attempt to gain unauthorized access to systems, data, credentials, models, or other users' information;
- interfere with, overload, probe, scan, reverse engineer, or disrupt the Service except where applicable law expressly permits such activity;
- use automated means to harvest the Service or reconstruct restricted internal datasets;
- bypass safety, privacy, access, rate-limit, or provider restrictions;
- submit malicious code, malware, or instructions intended to compromise systems;
- misrepresent NAVU output as verified professional advice or as a human professional's judgment.
9. Third-party providers and services
NAVU relies on third-party technology providers, including cloud and AI providers. Their availability, security controls, processing practices, and service terms may affect NAVU. NAVU may change providers or models when reasonably necessary, subject to NAVU's internal provider, privacy, and quality controls.
10. Third-party offers and marketplace activity
NAVU may display optional third-party offers, products, services, merchants, or marketplace content. Unless NAVU expressly states otherwise, the third party — not NAVU — is responsible for its product, service, fulfillment, pricing, warranties, and terms. NAVU is not responsible for third-party websites or services you choose to use.
11. NAVU intellectual property
NAVU and its licensors retain rights in the Service, including NAVU branding, software, interfaces, original design, schemas, rules, curated structure, and other protectable materials. These Terms do not transfer ownership of NAVU's software or systems to you. AI-generated material may not be exclusive to NAVU and similar content may be generated for others.
12. Feedback
A safety report authorizes review of the specific content you choose to submit for investigation and safety improvements. It does not grant permission to train models, populate shared meal records, or reuse private conversations as general product feedback. Review is not immediate and the report feature is not an emergency channel.
If you voluntarily send suggestions, bug reports, or product feedback, you allow NAVU to use that feedback to improve the Service without an obligation to compensate you, provided we do not treat private User Content as public feedback merely because it was processed by the Service.
13. Service changes, availability, and beta features
NAVU may add, change, suspend, test, or remove features to improve safety, reliability, or product quality. Beta, preview, shadow-mode, or experimental features may change more frequently. We do not guarantee uninterrupted or error-free availability. We will not intentionally enable a material DataWheel collection practice that conflicts with the then-current Privacy Notice.
14. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." NAVU DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE ACCURATE, COMPLETE, UNINTERRUPTED, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAVU AND ITS OPERATORS, AFFILIATES, SERVICE PROVIDERS, AND PERSONNEL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO THE SERVICE. WHERE LIABILITY CANNOT BE EXCLUDED, LIABILITY WILL BE LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID NAVU FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE CLAIM OR (B) $100, UNLESS APPLICABLE LAW REQUIRES A DIFFERENT RESULT.
16. Your responsibility for misuse
To the extent permitted by law, you are responsible for claims, losses, or costs arising from your unlawful misuse of the Service or your violation of another person's rights. This section does not require a consumer to waive rights that cannot legally be waived.
17. Suspension and termination
We may suspend or terminate access when reasonably necessary to address security, abuse, legal requirements, provider restrictions, or material violations of these Terms. Where feasible, we may provide notice or an opportunity to correct the issue, but immediate action may be necessary for security or legal reasons.
18. Privacy
The NAVU Privacy Notice and Consumer Health Data Privacy Policy explain NAVU's information practices, DataWheel shadow-mode posture, service-provider processing, and privacy rights.
19. Governing law and consumer protections
These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law rules, except to the extent another jurisdiction's mandatory consumer-protection law applies. Nothing in these Terms limits rights you cannot waive under applicable law. Unless applicable law requires otherwise, disputes that cannot be resolved informally may be brought in a court of competent jurisdiction in Connecticut.
20. U.S. state-specific rights
Residents of certain states may have nonwaivable privacy, consumer-protection, cancellation, disclosure, or other rights. These Terms are intended to operate together with those rights, not replace them. If a provision of these Terms conflicts with a mandatory state-law right, the mandatory right controls to the extent of the conflict.
21. Changes to these Terms
We may update these Terms as the Service evolves. We will post the revised Terms with a new effective date and provide additional notice where required by law. If a change materially affects your rights, we will use reasonable means to notify users before the change takes effect where required.
